To the worshipfull the cours of Bedford county setting in Chancery Humbly complaining sheweth unto your Worships. Your Orator John Eekhols about three or four years ago having had some feelings with Thomas Smith the defendant house in after named, who acted then as she has Shiriff under Samuell Hainstone. Your Orator did come to an agriement with the said Thomas Smith, the first year he acted as deputy sheriff in Bedford County concerning your Orators Quil rents lives and other own, and some Clerks ffee due from your Orator for which your Orator was to pay, the said Thomas Smith in Corn at the market price. And your Orator further says that he came to the same agreement with the said Thomas Smith for his Quis Rents livies and other dues, and some Clirks ffees due from your Orator the second year the said Thomas Smith acted as deputy Sherif in the said County of Bedford, for which your Oratorsays he was to let him have corn at the market price as aforesaid. And your Orator says, at the request of the said Thomas Smith, he, together with his miller one William Haynes, the first year delivered to the said Thomas Smith and his orders eight barrels of Corn, and the sum of year he delivered to the said Thomas Smith four barrels and a half of Corn, on the terms your Orator has before mentioned, after which (your Orators says) the said Thomas Smith wrote to him requesting your Orator not to deliver any more born, unless your Orator should receive an order from under the said Thomas Smiths Land. But now so it is may it please your Worship that the said Thomas Smith, hath commenced a suit at law, in this Worshipful Court against your Orator, for a considerable sum of money, without allow in your Orator his Just credits and hath recovered a Judgment for the sum of with Cost against your orator, all which acting and doing of the said Thomas Smith are contrary to equity and good conscience, and tind to the manifest wrong, Ingury and oppression of your Orator In tender consideration, whereof, and for as much as your Orator is without remedy in the Pumises at the common law, and is only properly relevable before you. Woishops in Equity, where matters of paid, rigorer and oppression are properly moderated. and directed.
