Probate Court

July 27 1871

Thul? Allm? P. Stendivant? Judge. This day came William A Farner and filed his petition in writing, and under oath, and also otherwise proved to the court that Samuel M Echols departed this life in this state during the late war, that his death has been known more than forty days, that decedent in his lifetime has a conveyance made to him of certain lands which were the separate estate of his wife Martha Echols, and since that time the said Martha Echols has conveyed to petitioner her titles to said land; that petitioner is desirous to have the said deed reformed so as to rennene? the shade of title, and that it is necessary to file a Bil? in Chancery for that purpose and that it is necessary to hand and administrator appointed on said Estate and made a party to said Bil? and praying the Court thenfore to commit a special and limited administration upon said Estate to Hinam H Pass the General Administrator of this County. And said William N. Gardner having given Pona?, conditioned as required by law in such cases, which has been taken and duly approved by the Judge of this Court. It is ordered, adjudged and dicd? that the said Hiram H Pass as the General Administrator of this county, he and his? hereby appointed administration of said Estate, and that Litting? of Administration be duly issued authorizing him to administer in his said official capacity, in the affairs of said Estate, only so far as pertains to said suit for the purpose of reforming said deed, and for the interest of said Estate in said proceeding It is for the ordered, that saw petition and hand be recorded
