The State of Alabama

Tallapoosa County

Know all men by these presents that I John W. Echols of the State and County aforesaid for and in consideration of the sum of one thousand six hundred dollars to him in hand paid by [N/H?] [J/T?] Norris of the same State and of Butler County the receipt whereof is hereby acknowledged have bargained and sold and by these presents do bargain sell and convey to the said [N/H?] [J/T?] Norris the following described land to wit the north east quarter 1/4 of section 33 Thirty three Township 22 Twenty Two of Range 23 twenty three in the Tallapoosa land district to have and to hold said premises unto the said [N/H?] [J/T?] Norris his heirs and assigns forever and the said John W. Echols will warrant and defend the above granted premises unto the said [N/H?] [J/T?] Norris, his heirs and assigns against the legal claim and demands of heirs the said John W. Echols his heirs and assigns and against all other persons claiming claiming under the said grantor. Lucy Echols a wife of the above named John W. Echols in consideration of one dollar to her in hand paid does hereby release to the said [N/H?] [J/T?] Norris all her right of dower in and to the above described land.

In witness whereof the said John W. Echols and Lucy Echols have hereunto set our hands and seals this the 21 day of Oct in the year our Lord 1862.

The land being sold by J. W. and Lucy Ann Echols is the northern half of AL5070_.138, originally patented by William Dougherty and issued 7/1/1841.

Note that by 1862, the civil war was underway; Alabama seceded from the union on January 11, 1861. John Washington Echols is believed to have been born circa 1811, making him approximately 51 at the time of this sale and outside of the age range for forced conscription; however, per Military Pension Records 1879-1940, he died due to sickness as a solider and his wife received a pension under "Relief by Widows of Confederate Soldiers or Sailors" while she was living in Butler County. Thus, this record could align with John W. Echols' joining of the CSA.

Know all men by these presents that we Martha Echols, B.F. Echols, Mary J. Echols, T. J. Echols, Sarah A. Echols and Virginia E Echals for and in consideration of five hundred and Twenty four dollars to us in hand paid by Wm A Gardner, the receipt whereof we do hereby acknowledge, do hereby give grant bargain sell enfeoff? and conferm unto the said Wm A. Gardner his heirs and assigns the following described land to wit. the North half of Section Thirty four in Township Twenty two of Range twenty three containing three hundred and eight & thirty four hundredths of an acre. To have and to hold the aforegranted premises to the said W A Gardner his heirs and assigns to their use and behoof forever and we do hereby covenant with the said Wm A Gardner his heirs and assigns that we are lawfully seized? in fee of the aforegranted premises, that they are free of all encumbrances, that we have a good right to sell and convey the same to the said W. A. Gardner his heirs and assigns that we will warrant and defend the said premises to the said W. A. Gardner his heirs and assigns and that we will warrant and defend the said premises to the said Wm A Gardner his heirs and apigns forever against the lawful claims and demands of all persons.

Know all men by these presents that whereas I am justly indebted to Leroy Blythe in the sum of One hundred and sixty four 6/100 dollars, in hold cove'denced? by a promissory note due an payable the 1st day of December 1870, money advanced bursa? fide? to enable me to make my present crop, and without- which it would be impossible for me to make such crop, and being desirous to secure the said Levy? Blyche in the payment of said sum of money have this day bargained and sold and by these presents do grant, bargain and sell unto the said Levy? Blyche the following described property the right and title I guarantee to be in me, and that it is free from all encumbrance, to wit; The West half of the South East quarter of Section 21, Twenty-one in Township 22, Twenty-two, Range, 23, Twenty-three, in said county and state. Also all of my interest in the crop of wheat, Corn, oats, cotton &c, grown by me during the year 1870, it being two-thirds of the entire crop. To have and to hold the foregranted property unto him, the said Livroy? Blyche his heirs and assigns forever: upon the following conditions, nevertheless should I pay off and discharge said note at maturity or cause the same to be done, then this obligation to be null and void: otherwise to remain in full force and effect, and the said Leoroy? Blyche is hereby authorized and fully empowered to seize and take possession of the foregranted property, and expose the same to sale at public outory, to the highest bidder, for cash, after having first given ten days notice of the time, place and hems? of sale, together with a description of the property, posted at Dadeville in Tallapoosa County. Ala, and the proceeds of said sale apply to the satisfaction of said debt and expences of this mortgage and sale, the balance of any pay over to the maker of this instrument, or his legal representative. In witness whereof I have hereunto set my hand and seal the 6th day of May 1850.

This indenture, made this twentieth day of April in the year of our Lord One thousand Eight Hundred and Seventy between Samuel E Daily of the county of Henry and State of Georgia of the one part, and Lucy Ann Echols of the county of Tallapoosa and State of Alabama of the other part, Witnesseth, That the said Samuel E Daily for and in consideration of the sum of one Hundred and fifty dollars, to him in hand paid, at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, hath granted bargained and sold, and by three presents doth grant bargain, Sell and convey unto the said Lucy Ann Echols her heirs and assigns, all that Tract or Parcel of Land situated, lying and being in State of Alabama County of Tallapossa, and Known as West half of South East quarter of Section 21, Twenty one in con- ship 22, twenty-two, Range, 23, Twenty-three, lying and being in said county of Tallapossa & State of Ala.

To have and to hold the said Lucy Ann Echols with all and singular its rights, members and appurtenances thereof, to the same being belonging or in any ways appertaining to the only proper use benefit and behoof of her the said Lucy Ann Echols her heirs executors, administrators and assigns, in fee simple?

And the said Samuel E. Daily for himself his heirs, executors, and administrators, the said bargained premises unto the said Lucy Ann Echols her heirs, executors, administrators and assigns, against the said Samuel E. Dailey his heirs executors, administrators, and all and every other person or persons shall and will warrant and forever defend the right and title thereof against themselves and against the claim of all other persons whatever.
